  • You must be legally present in order to receive premium subsidies and cost-sharing subsidies, and must meet the regular immigration requirements in order to be eligible for Medicaid.
  • You can only receive premium and cost-sharing subsidies if you're not eligible for employer-sponsored coverage that the ACA deems affordable.
  • In almost all states, children are eligible for CHIP in households with incomes that exceed 200% of poverty (all the way up to 400% in NY). If your children are eligible for CHIP, they’re not eligible for enrollment in a subsidized private plan. Adults can enroll themselves in a subsidized plan, and enroll the children in CHIP.
